4. Payment and Billing
All payments for services must be made as outlined in your client agreement or invoice. Late or missing payments may result in suspension or termination of Services. Fees paid are non-refundable unless otherwise specified in writing.
Payments are due according to the terms stated on your invoice or proposal. You are responsible for ensuring timely payment and providing accurate billing information.
5. No Refund Policy
Due to the nature of marketing and advertising services—which involve strategy, labor, technology costs, and third-party ad spend—all payments made to Vitality Medical Marketing Group are non-refundable.
Once work begins, resources are allocated and costs are incurred that cannot be recovered. This policy applies to all service types,including, but not limited to, paid advertising, website development, design services, consulting, and content creation.
In certain cases, if an error is made on our part, we will review and address it promptly to provide a fair resolution, but refunds are not issued under any circumstances.
6. Confidentiality and Privacy
We respect your privacy and protect your data in accordance with our Privacy Policy. You are responsible for ensuring any data you share with us complies with applicable privacy and data protection laws. If your organization requires a Business Associate Agreement (BAA) under HIPAA, we will provide one upon request before services begin.
7. Limitation of Liability
Vitality Medical Marketing Group is not liable for indirect, incidental, or consequential damages that may arise from the use of our Site or Services. Our total liability for any claim related to these Terms or our Services will not exceed the amount paid by you to Vitality in the twelve (12) months preceding the claim.
8. No Guarantee of Results
While we apply proven strategies and data-driven methods, marketing outcomes depend on multiple factors, including market conditions, budget, competition, and client participation. Vitality makes no guarantees regarding specific results, rankings, or revenue.
9. Third-Party Tools and Platforms
Our Services may involve integration with third-party tools such as Google Ads, Meta, or CRM software. Each platform has its own terms of service and privacy policies. We are not responsible for the performance, accuracy, or security of these external systems.
10. Modifications to Terms
We may revise these Terms from time to time. Any updates will be posted on this page with a revised “Last Updated” date. Continued use of our Site or Services after updates are posted indicates acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in a court of competent jurisdiction located in Suffolk County, New York.
